Deadlines
The general deadline to file an injury suit in Texas is two years, and much shorter notice deadlines apply to government bodies. The table and the exceptions are on our Texas personal injury laws page.
Fault, insurance and money
Texas shares fault by percentage, and insurance usually decides where the money comes from. Our personal injury lawyer San Antonio page explains both.
After a crash
The duties at the scene, the CR-3 crash report and the insurance claims are on our accident lawyer San Antonio page.
Your case and your lawyer
The stages of a case are on our personal injury attorney San Antonio page, and how to check a lawyer and a fee agreement is on our best personal injury lawyer San Antonio page.
Fees and case costs
The first consultation is free. You pay no attorney’s fee unless we recover money for you. We advance the costs of investigating and pursuing your claim, and if there is no recovery you do not repay those costs. How the fee and the advanced costs are paid out of a recovery is set out in the written fee agreement you sign before we start.
Legal information
These answers are general information about Texas law, not legal advice, and reading them does not create an attorney-client relationship. Your own claim depends on its facts. The attorney responsible for this site and the firm’s office are named at the foot of every page.
Questions people ask
How long do I have to file a personal injury lawsuit in Texas?
Generally two years from the day the claim accrues, usually the day of the injury (Civil Practice and Remedies Code section 16.003). For a death, two years from the date of death.
Is the deadline different for a child?
Yes. The time a person is under 18 is not counted (section 16.001), so a child’s two years usually begin at 18. Government notice deadlines can still apply, so do not wait.
What if a city vehicle or a VIA bus was involved?
The City of San Antonio requires written notice within 90 days under its charter, and other government units within six months. VIA, CPS Energy and SAWS take their own claims. Damages against government units are capped.
Can I recover if I was partly at fault?
Yes, unless your share is greater than 50 percent. Your damages are reduced by your percentage (Chapter 33).
What is the minimum auto insurance in Texas?
$30,000 per person and $60,000 per collision for injuries, and $25,000 for property damage (Transportation Code section 601.072).
What does PIP pay?
Reasonable medical expenses, lost income and, for someone not earning, essential household services, for expenses incurred within three years of the accident, whoever was at fault. It is part of every Texas policy unless rejected in writing.
The driver who hit me had no insurance. What now?
Your own uninsured motorist coverage may pay, unless it was rejected in writing, and your PIP pays medical bills and lost income regardless of fault.
How do I get my crash report?
Buy the CR-3 through TxDOT’s Crash Report Online Purchase System once the officer has filed it, which must happen within 10 days. A regular copy is $6 and a certified copy $8.
Do I have to talk to the other driver’s insurance company?
No. Report the crash to your own insurer, as your policy requires, but you do not have to give the other driver’s insurer a statement.
What can I recover?
Medical expenses actually paid or owed, future care, lost earnings and earning capacity, and noneconomic damages such as pain, mental anguish, physical impairment and disfigurement. Exemplary damages require proof of gross negligence, malice or fraud.
What is my case worth?
Nobody can tell you honestly on the first call. It depends on the injury, the treatment, the effect on your life, fault and the insurance available. We tell you early what helps and what hurts your claim.
How much does a lawyer cost?
The consultation is free. You pay no attorney’s fee unless we recover money for you, and if there is no recovery you do not repay the case costs we advance. The fee terms are in a written agreement, which Texas law requires for a contingent fee.
How long will my case take?
It depends on your injury and on whether a lawsuit is needed. If a suit is filed, the state time standard for civil jury cases is 18 months from the appearance date.
Will I have to go to court?
Most injury claims are resolved without a trial, by negotiation or at mediation. Bexar County’s district courts require mediation at least 45 days before trial.
A lawyer contacted me right after my accident. Is that allowed?
Written solicitation about an injury claim before the 31st day after the accident is a crime in Texas (Penal Code section 38.12), and a contract obtained through barratry can be voided by the client.
Do you speak with people outside San Antonio?
Yes. We represent people from New Braunfels, Schertz, Converse, Universal City, Live Oak, Leon Valley, Helotes, Boerne, Seguin and across Texas.
Is this a referral service?
No. Personal Injury Lawyers SATX is a website of LAWBOSS – Uvalle Law Firm, PLLC. Calls and forms go to the firm, and your claim is handled by the firm’s own attorneys.
